- Right Not to be Subject to Automated Decision-Making: the right not to be subject to decisions based solely on automated decision-making, including profiling, when the decision could have a legal effect on you or produce a similarly significant effect.
To allow you to exercise these rights easily and register your preferences regarding how Novapast uses your personal data, we will provide you access to the following settings through our page:
My Personal Data: allows you to control some of the categories of personal data we process about you, and gives you access to your personal data.
Notification Settings: allows you to select the communications you receive from Novapast and opt out of receiving newsletters.
Your customer account allows you to control how Novapast processes your personal data. It provides information about what happens if you adjust your settings on your customer page and how to stop receiving certain messages from Novapast. If you receive electronic marketing messages based on your consent or in any other way permitted by applicable law, you can, at any time, respectively withdraw such consent or declare your objection (unsubscribe) at no cost. The electronic marketing messages you receive from Novapast (e.g., those sent via email and/or newsletters) will also include a mechanism to stop receiving messages within the message itself (e.g., an unsubscribe link in the emails we send you, in the footer).

We will respond to your request within a reasonable timeframe, upon verification of your identity.
How Do We Collect Your Personal Data?
We collect your personal data in the following ways:
- When registering on Novapast: when you register on Novapast, we collect certain personal data so you can use the Novapast Service, such as your email address, date of birth, gender, address, and email.
- Through the use of the Novapast Service: when you use the Novapast Service, we collect personal data about your use of the Novapast Service, such as which products you have purchased and which categories you have visited.
- From third parties: we will receive personal data about you and your activity from third parties, including advertisers and partners we work with to provide you with the Novapast Service (see the section "Sharing your personal data" below). We will only use this personal data when you have given your consent to third parties or to Novapast for data sharing to take place or, in cases where Novapast has a legitimate interest in using the personal data, to provide you with the Novapast Service.

What personal data do we collect from you?

Personal data collected when you register on Novapast: these are the personal data you provide to allow you to register and use the Novapast Service. This includes your email address, date of birth, gender, and address.
Personal data collected with your permission that allows us to provide you with additional features or functionalities: we collect personal data with your permission when you contact us to offer you a personalized feature, such as printing on pastry material with the photo(s) you send to our commercial department. We may also collect your payment details when you purchase product(s) through our Service. The payment data collected may vary depending on the payment method you have chosen to make your purchase. The data we collect includes, for example, name, date of birth, card type, postal code, mobile phone, or the purchase history you have made on Novapast. If you choose to pay by invoice, we will provide your personal data to our payment processors to carry out a credit check and send you the invoices.
Survey, contest, and sweepstakes data: this personal data is used to allow you to register and participate in these types of promotions. The exact personal data collected will vary depending on the promotion.
Marketing data; this personal information is used to allow Novapast and our partners/service providers to send you marketing communications through the email marketing@novapast.com or through third parties on our accounts on different social networks (Facebook, Twitter, Instagram, etc.).
What do we use your personal data for?
When you use or interact with the Novapast Service, we use different technologies to process the personal data we collect about you for various reasons. Below are the reasons why we process your personal data, the associated legal bases on which we legally depend, and which allow us to process your personal data, and the categories of personal data used for these purposes:
Provide, personalize, and improve your experience with the Novapast Service and other services and products provided by Novapast, for example, by providing personalized, tailored, or localized content, recommendations, features, and advertising within or outside the Novapast Service (including for third-party products and services).
Understand how you access and use the Novapast Service to ensure the technical functionality of the Novapast Service, develop new products and services, and analyze your use of the Novapast Service, including your interaction with applications, advertising, products, and services that are available, linked, or offered through the Novapast Service.
Communicate with you for purposes related to the Novapast Service.
Process your payment to prevent or detect fraud, including fraudulent payments and fraudulent use of the Novapast Service.
Communicate with you, either directly or through one of our partners, for: marketing, research, participation in surveys, contests, sweepstakes, promotions, via emails, notifications, or other messages, according to the permissions you may have communicated to us (e.g., through the My Account page).
Offer you features, information, advertising, or any other content based on your specific location.
Sharing of your personal data
We have outlined the different categories of recipients of personal data collected or generated through your use of the Novapast Service.
Publicly available information: only if you have decided to leave a public comment on our page or on our social networks. In this case, we share your profile photo, your name, and your comment (for example, a message sent to our Facebook, Twitter, or Instagram profile publicly).
Information we may share: we use technical service providers that provide the technical infrastructure we need to supply the Novapast Service, particularly providers that host, store, manage, and maintain the Novapast page, its content, and the data we process. We use marketing and advertising partners to display more personalized content or to help us understand your use of the Novapast Service and thus provide you with better service. We may also share personal data with some marketing and advertising partners to send you promotional communications about Novapast.
We will share your personal data when we believe in good faith that it is necessary to do so to comply with a legal obligation under applicable law or respond to a valid legal process, such as a search warrant, court order, or subpoena.

We will share your personal data in cases where we sell or negotiate the sale of our business to a buyer or potential buyer. In this case, Novapast will continue to ensure the confidentiality of your personal data and inform you in advance that your personal data is being transferred to the buyer or is subject to a different Privacy Policy.
Data Retention and Deletion
We retain your personal data only for as long as necessary to provide you with the Novapast Service and for legitimate and essential business purposes, such as maintaining the performance of the Novapast Service, complying with our legal obligations, and resolving disputes. We retain some of your personal data as long as you are a user of the Novapast Service. For example, your personal data, your shipping addresses, your payment details, your purchase history, and your account information.
If you request it, we may delete or anonymize your personal data so that you are not identified, unless we are legally allowed or required to retain certain personal data, including the following cases:
- If there is an unresolved issue relating to your account, such as outstanding credit on your account or an unresolved claim or dispute, we will retain the necessary personal data until the issue is resolved;

We may display third-party advertisements and other content linked to third-party websites. We cannot control or be held responsible for the privacy practices and content of third parties. If you click on a third-party advertisement or link, understand that you are leaving the Novapast Service and any personal data you provide will not be covered by this Policy. Protecting Your Personal Data
We are committed to protecting our users' personal data. We implement appropriate technical and organizational measures to help protect the security of your personal data. However, please note that no system is completely secure. We have implemented various policies including pseudonymization, encryption, access, and retention policies to protect against unauthorized access and unnecessary retention of personal data in our systems.
The password protects your user account, so we recommend that you use a unique and strong password, limit access to your computer and browser, and log out after using the Novapast Service.
Changes to the Privacy Policy
Occasionally, we may make changes to this Policy.
If we make material changes to this Policy, we will provide you with prominent notice as appropriate under the circumstances, such as displaying a prominent notice within the Novapast Service or sending you an email. We may notify you in advance.
